Abstract
Farmers find in french law an extensive offer of legal forms for agricultural cooperations, which were especially established for agriculture. The GAEC, as the oldest agricultural legal form has the most significance amongst the types of associations. German right knows no own legal forms for agricultural cooperations. The "BGB-Gesellschaft (§§ 705 ff. BGB)", which is often chosen by farmers allows no secure liability limitation. The agricultural goals in both countries show clear differences. The offer of own agricultural legal forms for french farmers leads to a certain distortion in competition within the EU. Therefore, from an agricultural point of view, one should work towards equal treatment at european level. The introduction of an own agricultural legal form in Germany like the french example does not seem necessary.
