Abstract

Will the Internet of Things lead to a reform and novation of public administration? What legal and non-legal guidelines can influence such a technology or technological vision as the Internet of Things in the future? These two questions will be explored below. The article focuses on the so-called Internet of Things, a technological vision that is considered to have great potential for changing the state and society. This form of application of new technologies could fundamentally change governance and administration. The adoption of the Internet of Things is not a natural or automatic process; rather, it is influenced and controlled by the actions and decisions of the actors involved. Actors often exert this influence - consciously or unconsciously - without really being able to assess the consequences. Various means of controlling and influencing new technologies are available. Reference is made, for example, to strategies, technical and organizational aspects and guiding principles. In legal terms, a distinction is made in particular between regulations at constitutional level and at the level of simple law, whereby overarching principles can also come into play at the latter level. The article concludes with the question of what functions are assigned to law in this respect and refers to a proposal for an overarching classification of the functions of law in the adoption of new technologies into basic, limit and design.
