Abstract
The mountain forests of Upper Bavaria are burdened by pasture righs on about 75 000 ha. The occurrence of the forest dieback syndrome in the alpine mountains has made the removal of these rights an urgent task. Suggestions are made how this problem can be solved. First, the value of the pasture right is calculated applying the substitute cost approach. On this basis it is shown what alternatives are at hand for redeeming these rights. The question is examined to make land available for property or lease to the persons entitled, to allow a financial compensation by paying an annuity for the rights of pasture, to offer forested areas as a substitute, to change the rights of pasture into timber rights, to transfer the rights or remove them by reallocation of land. As a result it can be shown that a redemption of these rights is possible to a high degree, provided the respective legal, organizational, and contractural prerequisites will be established.
