Abstract
If Art. 22 GDPR is understood as a socio-technical design standard in accordance with Art. 25 GDPR, this opens up completely new perspectives in its application. In addition to interpretation and subsumption, the design process of automated decision-making systems comes to the fore, which must be influenced in terms of the rights, freedoms and legitimate interests of the data subject. Such an interpretation is not only desirable for dogmatic reasons, but also for reasons of legal policy, as current legislative developments also show.
